Process For Family Immigration    

Spouse

Spouses have the same rights as the spouse already in Germany. For example if the spouse that already resides in Germany has the right to work, the spouse that joins the other in Germany will have the same right to work.

Same Sex Spouse

  • The marriage must be legally recognized in the location where you were married as well as under local law

    • The laws vary location to location; it is your responsibility to be sure your marriage was legally binding by the laws where the marriage occurred.

    • You will also hold the responsibility of proving the marriage was legal.

 

Step by Step Procedures

  • Complete Residence Permit Application   

  • Provide a copy of the passport for spouse living in Germany.

  • 2 passport photographs.  Strict requirements

  • Basic knowledge of language skills should be demonstrated before entering the country. A certificate of the Goethe-Institut for the A1 language examination “Start Deutsch 1” must be submitted with all other application documents. The  “Start Deutsch 1” can be taken at the Goethe-Institut. It can also be taken at a licensed examiner’s, an institute that is entitled to conduct tests of the Goethe- Instiut in country of residence. 

  • Spouse residing outside of Germany must possess a basic knowledge of German. This is to ensure that the spouse can conduct simple communication in Germany. Exceptions are as follows:

    • Spouse is a citizen of a member state of the European Union (EU) (Germany not included).

    • Spouse has a physical, mental illness, or handicap that renders them incapable of demonstrating basic knowledge of the German language.

    • Spouse possesses a university degree and would have the possibility of finding work in Germany based on your language skills (minor integration required).

    • Spouse does not want to reside in Germany on a permanent basis.

    • Spouse in Germany has a residence permit as a highly skilled worker, researcher, company founder, person entitled to asylum, recognized refugee, or holder of a permanent right to residence from other EU countries.

  • Marriage certificate with apostille.  An apostille is a specific text that certifies the authenticity of the signature, the capacity in which the signer of the document has acted and, where appropriate, the identity of the seal of stamp which the document is taken). The Embassy cannot issue Apostilles.  Apostilles for marriage certificates are issued by Directorates, which are General or the Secretaries of the Interior of the respective States through the Consulate Office.

  • Invitation letter from husband or fiancé residing in Germany with full address in Germany.   The letter should be formal and include the husband or fiancé’s home address in Germany.

  • Submit the original documents along with 2 copies of all documentation. 

  • Documents not in German should be submitted with German translation along with 2 copies.

  • Visa for spouses of German citizens are granted free of charge.

  • Applications and all other documentation must be submitted in person at the German Embassy. No  payments will be accepted online or through mail.

  • Visas are approved usually within 2-10 days.

  • The Embassy will not provide information over the telephone for security reasons. All  applicants will be notified by e-mail with the status of applications. Applicants may contact the Embassy in writing as an exception. 

  • If the candidate's application has been approved, the Embassy provides an entry visa to the candidate.

  • Upon arriving in Germany, the foreign national and any accompanying family members must apply for their work and residence permits at the local foreigner’s authority.  Locations and full details will be provided at time of receiving entry visa.

     

Children

Children have the right to join parents in Germany until the age of 16, if both parents, or the custodial parent are permanent residents. Minors over the age of 16 who can speak German or determined by the authorities to successfully integrate will be accepted into Germany. The following documentation is needed for children to be reunited with parent/parents in Germany.

  • Copy of passport of father/mother living in Germany. 

  • Children of German citizens will be granted Visas free of charge.

  • Submit the original documents along with 2 copies of all documentation.

  • Documents not in German should be submitted with German translation along with 2 copies.

  • Visa for children of German citizens are granted free of charge.
